Mr Geoffrey Mogridge breached Right 4(2) of the Code of Health and Disability Services Consumers' Rights (the Code) as he engaged in a sexual relationship with a client. He also breached Right 2 of the Code as he violated his fiduciary obligations, abused his position of trust, and exploited the client.

The matter was referred to the Director of Proceedings. The Director reviewed the matter and, taking into account the preference of the complainant not to participate in a hearing and the fact that the public interest was being served by the two claims against the practitioner that had already been brought in the Human Rights Review Tribunal, she decided to take no further action.
